REPORT OF THE REGULAR MEETING OF GORHAM TOWN COUNCIL
October 5, 2004  

        The meeting opened with the Pledge of Allegiance to the flag.

Roll Call:  Present:  Chairman Loveitt; Councilors Hamblen, Phinney, Robinson, Justice, Willett and Dugas; David Cole, Town Manager and Brenda Caldwell, Town Clerk

Moved by Councilor Phinney, seconded by Councilor Dugas and VOTED to approve the Minutes of the September 7, 2004 Regular Meeting and the September 23 Special Meeting as printed and distributed.  7 yeas.

Chairman Loveitt announced that at this point public hearing #2 and Item #7021 will be taken out of order.  For purposes of continuity the discussion and action taken under this public hearing and this item will be shown in its proper consecutive order.

John Bump spoke of his disappointment with the Council for voting to not make a recommendation on the referendum question on the ballot.  Vernon Plummer spoke in opposition to the referendum question  and Jeff O’Donnell expressed his disappointment to the Council for not putting the Planning Board recommendation on the ballot.

Councilor Hamblen spoke of his concern at the Queen Street right-of-way not being accessible and asked that the item be on next month’s Council agenda so the Council can discuss the issue.  Councilor Phinney added that the Council had made it very clear that Queen Street was still a Town road and that the Town still had interest in that road.

Chairman Loveitt reported that the Shaw School Committee has been meeting with Mr. Cole and PDT to do a thorough review of the Shaw School.

The Town Manager reported that he has presented a 30-year service pin to Carol Googins of the Finance Department  and an announcement that Maureen Finger, the Finance Director, was recently awarded a certificate of achievement for excellence in financial reporting by the Government Finance Office Association of the US.  He also showed the Council the plaque the Town received for this award.

        Old Business

Item #6993.  Moved by Councilor Phinney, seconded by Councilor Robinson and VOTED to postpone action on a request from Shaw Brothers to discontinue a portion of Gambo Road beginning at the eastern edge of the Bousquet property (Tax Map 72, Lot 17 ), thence northeasterly to the Presumpscot River to the next regular meeting of the Council.  7 yeas.

Item #7010.  Moved by Councilor Phinney, seconded by Councilor Robinson and VOTED to postpone action on an application for a Class II Victualer’s License in the name of Susan Duchaine, d/b/a The Fry Guy at Narragansett Street (formerly Uncle Earle’s) to the next regular meeting of the Council.  7 yeas.

       New Business
        
The meeting recessed for a public hearing on an application for a Combined Massage Establishment/Massage Therapist License in the name of Julie K. Brown d/b/a Body Balance at 165 Mosher Road, Gorham.  There was no public comment and the hearing closed.

Item #7020. Moved by Councilor Robinson, seconded by Councilor Phinney and ORDERED that the Town Council authorize the issuance of a Combined Massage Establishment/Massage Therapist License in the name of Julie K. Brown d/b/a Body Balance at 165 Mosher Road, Gorham.  7 yeas.

The meeting recessed for a public hearing on an application for a Class II Victualer’s License in the name of Sara J. Littlefield, d/b/a The Gorham Grind to do business at 18 South Street.  Joseph Baker, owner of The Gorham Grind spoke.  There was no other public comment and the hearing closed.

Item #7021.  Moved by Councilor Robinson, seconded by Councilor Phinney and ORDERED that the Town Council authorize the issuance of a Class II Victualer’s License in the name of Sara J. Littlefield, d/b/a The Gorham Grind to do business at 18 South Street.  7 yeas.

Item #7022.  Moved by Councilor Justice, seconded by Councilor Dugas and ORDERED that the Town Council approve the issuance of a Malt, Spirituous and Vinous Liquor License in the name of Sebago Brewing Company.  7 yeas.

Item #7023.  Moved by Councilor Willett, seconded by Councilor Justice and ORDERED that the Town Council vote that the polls be open for the November 2, 2004 State General Election and the Gorham Municipal Election between the hours of 7:00 a.m. and 8:00 p.m.  7 yeas.

Item #7024.  Moved by Councilor Dugas, seconded by Councilor Willett and ORDERED that the Town Council vote to set the date of  November 9, 2004 as the date of the November Regular Council Meeting.  7 yeas.

Moved by Councilor Phinney, seconded by Councilor Robinson and VOTED to adjourn.  7 yeas.  Time of adjournment - 7:35 p.m.
